Your service provider may charge you for using access numbers, such as 020 and 0800; we recommend you check this with your service provider before using this product. As matter of policy we will not deliberately disconnect calls less than provided that there is sufficient credit for the call. Disconnection may occur for reasons beyond Saxar Ltd (UK)'s control.
We may suspend provision of the services in the event of non-payment by wholesalers, retailers and / or distributors of One2One calling. In the event that we are forced to do so you should approach the seller from whom you purchased the goods and / or services.
Save where by provided for by statute we do not refund purchases made, where you purchase one2onecalling products and / or services online. These will be delivered to you electronically

1. Definations
1.1 "Customer" means the individual who buys Goods from Saxar Ltd (UK) and that
has a UK billing address for the payment card with which they purchase the goods;
1.2 "Contract" means the contract between Saxar Ltd (UK)and the Customer for the
sale and purchase of Goods incorporating both these terms and conditions and those
terms and conditions relating to one2onecalling available on the Website;
1.3 "Goods" means the goods that the Customer agrees to buy from Saxar Ltd (UK)and
which goods give access to the Saxar Ltd (UK)Services;
1.4 "Saxar Ltd (UK)e" means Saxar Ltd (UK)Services Limited, a company incorporated
in England having its registered office at 145-157 St John Street, London, EC1V

1.5 "Saxar Ltd (UK)Services" means telephony services provided to end-users by Saxar
Ltd (UK), one of its subsidiaries or affiliates
1.6 "Website" means the website at www.one2onecalling .com
2. Ordering and delivery of Goods
2.1 Customer accepts that the placing of any order shall be deemed as making an
offer to purchase which is subject to acceptance by Saxar Ltd (UK) and which may
be rejected for any reason. Saxar Ltd (UK) shall not be bound to supply the Goods
unless it has confirmed acceptance of an order by any method it deems appropriate
including by the delivery of the Goods.
2.2 Where the Goods ordered by the Customer are not available the Customer will
be informed and may either wait until the Goods are available, cancel the order
and receive a full refund or receive an alternative product of the same face value.
2.3 Goods purchased through the Website are delivered electronically to the email
address that you provide.
2.4 Goods supplied will normally be delivered within 24 hours of receipt of payment.
2.5 Title and risk in the Goods shall pass to the Customer upon delivery of the
Goods to the email address provided by the Customer when making a purchase.
3 Price and payment for Goods
3.1 The Price of the Goods shall be that stipulated on Saxar Ltd (UK)'s Website.
The Price is inclusive of VAT.
3.2 The total purchase price, including VAT, will be displayed on the website prior
to confirming and paying for the order.
3.3 Payment of the Price plus any applicable charges must be made in full before
the Goods are delivered. Payment is to be made by any of the credit or debit cards
accepted by Saxar Ltd (UK)e, details of which are stated on the Website. All orders
are subject to authorisation of payment by the relevant card issuer prior to despatch
of the Goods.
4. Rights of Saxar Ltd (UK)
4.1 Saxar Ltd (UK) reserves the right to adjust any product or price on the Website
at any time.
4.2 Saxar Ltd (UK) reserves the right to withdraw any Goods from sale even if listed
on the Website at any time.
4.3 Saxar Ltd (UK) shall not be liable to anyone for withdrawing any Goods from
the Website or for refusing to accept an order.
5. Warranties
5.1 Except where the Customer is dealing as a consumer, all other warranties, conditions,
or terms relating to fitness for purpose, merchantability or condition of the Goods,
whether implied by statute, common law or otherwise are excluded. Any recommendation
or suggestion relating to any of the Goods and made by Saxar Ltd (UK) is given in
good faith, but it is for the Customer to satisfy himself as to the suitability
of the Goods for the Customer's purposes.
5.2 The Goods will be delivered online. In such circumstances, Saxar Ltd (UK) will
not be liable for any temporary unavailability of such Goods due to any failure
of the Website, any telecommunications system and / or the world wide web, including
any downtime of the Website or telecommunications systems to planned or emergency
maintenance.
5.3 Saxar Ltd (UK) bears no liability for non-delivery where the address you have
entered on the website is incorrect or the email address fails for some reason.
6. Cancellations / Returns
6.1 one2onecalling bills in regular recurring monthly cycles commencing from the
date on which one2onecalling accepts your order and ending on the day before the
same date in a following month ("Billing Period"). If you want to cancel this Agreement
in full, or if you want to cancel some but not all of your lines and other features
of the Service, for any reason you must telephone us by calling 0207 100 5721 (or
such other telephone number as may be posted on our web site from time to time).
Your telephone notice of cancellation must be received no later than 2 working days
before the end of the then current Billing Period otherwise cancellation will not
become effective until the end of the next following Billing Period. one2onecalling
will send you confirmation of your cancellation by email. A working day does not
include Saturdays, Sundays or any public or bank holiday in the United Kingdom.
6.2 You will be charged any applicable disconnection fee in respect of each line
and other Service feature disconnected and you will be responsible for paying all
charges under the applicable call plan including without limitation unbilled charges
and other charges all of which immediately become due and payable. If a line or
other Service feature is disconnected after 1 year following the activation date,
the applicable disconnection fee is waived.
6.3 If the Goods are defective, Customer must inform Saxar Ltd (UK) within 7 days.
If the Customer fails to do so the Customer shall be deemed to have accepted the
Goods.
6.4 Where a claim of defect or damage is made the Goods shall be deactivated by
Saxar Ltd (UK)e. If on inspection / investigation by Saxar Ltd (UK) the goods are
found to be defective, the Customer shall be entitled to provision of replacement
Goods by Saxar Ltd (UK)of the same type and denomination.
6.5 If you are a Customer, in addition to the rights set out herein, you have statutory
rights under the Customer Protection (Distance Selling) Regulations 2000 as follows:
6.5.1 Under the Distance Selling Regulations (2000) in the United Kingdom, Customer,
if a UK resident, has the right to cancel the agreement until the end of the 7th
working day after the date on which the contract was formed.
6.5.2 Where Customer uses the Saxar Ltd (UK) services before your right to cancel
expires Customer loses the right to cancel the contract.
6.5.3 Where Customer chooses not to use the goods or use the Saxar Ltd (UK) Services
until after the end of Customer's right to cancel Saxar Ltd (UK)will not provide
the goods or use of the Saxar Ltd (UK)Services until after Customer's right to cancel
expires.
6.5.4 Where Customer has the right to cancel and wants to cancel the contract Customer
must write to Saxar Ltd (UK), ensuring that Customer's letter reaches Saxar Ltd
(UK) before the expiry of Customer's right to cancel, to tell Saxar Ltd (UK)that
Customer wants to cancel the contract.
6.5.5 Where Customer has the right to cancel and gives Saxar Ltd (UK) notice that
Customer wants to cancel Saxar Ltd (UK) agrees to return any payment made by Customer
within 30 days of the date on which Saxar Ltd (UK) receives Customer's notice.
7. Limitation of Liability
7.1 Except as may be implied by law where the Customer is dealing as a Customer,
in the event of any breach of these terms and conditions by Saxar Ltd (UK) the remedies
of the Customer shall be limited to damages which shall in no circumstances exceed
the Price of the Goods paid for and Saxar Ltd (UK) shall never be liable for any
indirect, incidental or consequential loss or damage whatever suffered by the Customer.
7.2 Nothing in these terms and conditions shall exclude or limit the liability of
Saxar Ltd (UK) for death or personal injury resulting from the negligence of Saxar
Ltd (UK)or that of Saxar Ltd (UK)'s agents or employees.
8. Severability
A finding that a term of these terms and conditions, is or has become, invalid,
illegal or unenforceable in any respect under governing law it shall not affect
or impair the validity, legality or enforceability of any other terms of these terms
and conditions so long as the purpose of these terms and conditions are still capable
of performance.
9. Jurisdiction
Any dispute relating to the validity, interpretation or execution of these terms
and conditions shall be settled according to the Laws of England and the parties
submit to the non-exclusive jurisdiction of the English courts.
